Town of Long Lake Plan Commission
Meeting Minutes – January 7, 2010

Chairman Bill Austin called the meeting to order at 6:00 p.m.
Members Present: All members present
Minutes of the December 3, 2009 meeting were reviewed and approve with the words “motion carried” added at the end of the Morningside Road motion.
Old Business: Leroy announced the town board had offered the Building Inspector’s position to John Mattson pending his acceptance and signing a contract
New Business: Chairman Austin asked Barb Logue to present the ATV Route. The Recreation Committee, in order to provide access to Long Lake businesses on the west side of Long Lake, asked for support from the Plan Commission to open three sections of County Highway [Section 1: Hwy M - Laundromat Rd to Prop’s, Section 2: Town Hall to Hobo’s Hideout and Section 3: Hwy D from Burma Rd to Hwy M]. A motion was defeated to support the request as presented to the County Hwy Dept for approval. Safety regarding traffic from the Pioneer past Hobo’s was the primary issue against. The road is felt to be hazardous for bicycles and pedestrians with no shoulders. The proposal as submitted is not supported by the Plan Commission. An alternate proposal was mentioned by Commission member Romsos but not pursued by the Recreation Committee chairman.
Leroy reported that no further correspondence regarding the Morningside property had been received from attorney Thiel. Thus the correspondence covered by Allan Barta’s March 2008 review is everything received on this matter. Leroy also reported that he has not been able to get Thiel’s office to return his calls and therefore has not been able to ask Thiel for a cost estimate to proceed with the research and paperwork as Thiel had recommended in his correspondence. Leroy was planning to ask Joe Thrasher if he would take the project. If this were to be the case, the commission recommended he review this matter with the town board and proceed accordingly.
Chairman Austin presented his correspondence with the Wisconsin Towns Assn. regarding the position/function of a Plan Commission without an adopted County Comp Plan. In summary the town and county ordinances, variances and zoning laws can continue to be implemented, but after 1/1/10 are subject to legal challenge. It appears State shoreline ordinances would continue to be enforceable. Lack of continuity and consistency exist without a county plan in place.
Note: Long Lake Township does have a Comprehensive Plan, but it has no real authority without a County Plan. Although uncertainty exists, the Plan Commission decided to continue forward. We need to get enough current copies of the Town’s Comp Plan for all members. In light of this information, Leroy will order copies.
Town Ordinances 2004-2, 2005-4 and 2005-5 were reviewed. Discussions took place about the lack of communications between any of the parties regarding ordinances, variances, zoning permits and/or building permits/inspections. It appears when the town ordinances were originally written they described implementation. However, no mechanisms were ever established to provide for documentation, communications and the creation of a paper trail. As an example there is no administrative mechanism to issue and pursue collection of citations, penalties or fees. Chairman Austin agreed to request the attendance of our Town Board and Bldg Inspector at our next scheduled meeting Feb 4th. This joint meeting’s sole purpose would be to review situations and discuss the creation of administrative mechanisms to establish proper communications and avoid the issues we have today.
Many questions, suggestions and comments made at our meeting will provide agenda items for the joint meeting requested by Chairman Austin. Plan Commission chairman will provide a memorandum of action items to the town board for their review.
